Welcome to Cre8tive Hands. These Terms of Service (“Terms”) govern your access to and use of our digital greeting card service, website, and related features (together, the “Service”).
By using Cre8tive Hands, you agree to these Terms. If you do not agree, you must not use the Service.
Early access notice: Cre8tive Hands is currently in an early access phase. Some features, policies, and limits may change as we improve the Service. Where appropriate, we will update these Terms and notify users of material changes.
1. Use of the Service
Cre8tive Hands provides a platform that allows users to create, personalise, store, and send digital greeting cards.
By using the Service, you agree to:
- use the Service only in a lawful manner and in accordance with these Terms;
- provide accurate information where requested;
- keep any saved access or recovery codes reasonably secure;
- be responsible for activity carried out through your device or using information you submit through the Service; and
- not misuse, disrupt, or interfere with the Service.
Unless we explicitly agree otherwise in writing, the Service is provided for personal, non-commercial use.
2. Eligibility
You may only use the Service if you are legally capable of entering into a binding agreement under the laws that apply to you.
If you are using the Service on behalf of a business, organisation, or another person, you confirm that you have authority to bind them to these Terms.
3. User Content
You may be able to create, personalise, store, or send content through the Service, including messages, names, sender details, recipient details, and other information you submit in connection with a card (“User Content”). The underlying card artwork, templates, and built-in effects remain our content or the content of our licensors.
You retain ownership of any original content you lawfully provide through the Service, subject to the rights you give us under these Terms.
You are responsible for ensuring that your User Content:
- is lawful;
- does not infringe the rights of any third party;
- is accurate where accuracy matters; and
- complies with these Terms.
4. Licence You Grant to Us
To operate the Service, you grant Cre8tive Hands a limited, non-exclusive, revocable, worldwide licence to:
- host, store, process, copy, format, and display your User Content;
- transmit and deliver your cards to recipients on your behalf;
- make technical changes needed to display or deliver content across devices and platforms; and
- use your User Content only as reasonably necessary to provide, maintain, secure, support, and improve the Service.
This licence exists only for the purpose of operating the Service and does not transfer ownership of your User Content to us.
5. Acceptable Use
You must not use Cre8tive Hands to:
- send spam, bulk unsolicited messages, or repetitive unwanted communications;
- create or distribute content that is unlawful, abusive, threatening, defamatory, obscene, hateful, discriminatory, or otherwise harmful;
- harass, threaten, intimidate, or exploit others;
- impersonate any person, organisation, brand, bank, government body, or trusted service;
- use the Service for phishing, fraud, scams, deception, or social engineering;
- send cards to recipients without appropriate consent or as a vehicle for unwanted contact;
- infringe copyright, trade mark, privacy, publicity, or other legal rights;
- attempt to gain unauthorised access to accounts, systems, or data;
- interfere with the security, stability, or proper operation of the Service; or
- use automated tools, bots, scripts, or scraping methods in a way that places unreasonable strain on the Service or bypasses intended limits.
We may investigate suspected misuse and take action as described in these Terms.
6. Fair Use and Storage Limits
To keep the Service reliable and fair for all users, we may apply reasonable usage, rate, and storage limits. These may include limits on:
- the number of cards you can create over a given period;
- the rate at which cards may be emailed, scheduled, or looked up with recovery codes;
- the number of card records or saved recovery codes surfaced through My Cards on a device;
- the length of time certain content is retained; and
- anti-abuse protections such as view-count caps, throttling, or temporary restrictions.
Unless we state otherwise, the Service currently works broadly as follows:
- cards you create remain available until you delete them, subject to abuse enforcement, legal requirements, or operational necessity;
- if you remove a card through My Cards, it moves to Trash for up to 7 days before permanent deletion;
- scheduled email deliveries are paused while a card is in Trash;
- scheduling is available without an account, but applies only to cards you ask us to email at a future date and time; and
- view counts shown in My Cards are capped at 50 unique viewers per card.
My Cards also depends partly on browser storage and saved recovery or access codes. Clearing site data, changing browsers, or using private browsing can remove the local dashboard until a saved code is re-entered.
These limits may change from time to time, especially during early access. Where changes are material, we will communicate them appropriately.
We may also restrict or suspend use that, in our reasonable opinion, is excessive, abusive, harmful, or risks the stability of the Service.
7. Content Review and Access to Card Data
We do not routinely read or actively monitor the private messages in your cards.
However, in order to operate the Service, we must technically store and process information such as:
- the cards you create;
- the personal messages you include;
- sender names and details;
- recipient names and details; and
- associated delivery, scheduling, and card-management information.
Because of this, authorised access to relevant data may occur in limited circumstances, including:
- when you or a recipient report a technical problem and we need to investigate;
- when we receive a complaint or report of abuse, harassment, threats, or harmful conduct;
- where we reasonably suspect unlawful activity, fraud, phishing, misuse, or a breach of these Terms; or
- where access is required to comply with legal obligations, law enforcement requests, court orders, or to protect rights, safety, and security.
In such cases, we may review the relevant content and related information only to the extent reasonably necessary to investigate, resolve issues, enforce these Terms, protect users, or comply with the law.
We do not use this access for general surveillance or for unrelated marketing.
8. Recipient Information and Consent
You are responsible for ensuring that you have the right to provide recipient details and to contact the recipient through the Service where required by law.
You are also responsible for ensuring that any recipient information you provide, such as email addresses or names, is accurate.
We are not responsible for failed delivery, misdelivery, or issues caused by inaccurate recipient details or lack of recipient consent.
9. Intellectual Property
All rights in the Service itself, including our website design, branding, templates, graphics, software, features, and original platform content (excluding your User Content), belong to Cre8tive Hands or our licensors and are protected by intellectual property laws.
You may not, unless permitted by law or with our prior written permission:
- copy, reproduce, republish, or redistribute our proprietary content;
- modify, reverse engineer, or attempt to extract source code from the Service;
- use our branding, logos, or trade marks in a misleading or unauthorised way; or
- resell or commercially exploit the Service or our materials.
10. Availability and Changes to the Service
We aim to keep Cre8tive Hands available and functioning properly, but we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
We may, at any time and without liability, do any of the following:
- update, improve, or modify the Service;
- add, remove, suspend, or discontinue features;
- impose or change technical, storage, or usage limits; or
- temporarily interrupt access for maintenance, security, operational, or development reasons.
11. Delivery Disclaimer
We will make reasonable efforts to send and display cards as intended through our Service.
However, we cannot guarantee:
- delivery to third-party systems, inboxes, or external messaging services;
- that recipient email providers, spam filters, firewalls, device settings, or external platforms will accept or display cards correctly;
- that a recipient will open, view, or receive a card at a specific time; or
- uninterrupted access once content depends on systems outside our control.
Delays, filtering, blocking, rendering issues, and non-delivery can occur for reasons beyond our control.
12. Advertising and Service Model
Cre8tive Hands is intended to operate as a free, ad-supported service.
This means:
- users are not charged subscription fees for standard access to the Service;
- we may display advertising on the website or within parts of the Service; and
- we may use advertising providers in future to help support the cost of hosting, development, maintenance, and operation.
Your use of the Service does not guarantee that ads will always be shown, nor that any specific advertising format will remain the same.

13. Restriction and Termination of Access
We may suspend, restrict, or terminate your access to the Service, with or without notice, if we reasonably believe that:
- you have breached these Terms;
- your use of the Service creates risk, harm, legal exposure, or disruption;
- we are investigating suspected fraud, abuse, or unlawful conduct;
- your activity is excessive or threatens system integrity; or
- we are required to do so for legal, operational, or security reasons.
You may stop using the Service at any time.
If your access is restricted or terminated, we may delete or disable access to associated content, subject to legal, operational, and backup requirements.
14. Right to Remove Content
We may remove, block, disable, refuse to send, or restrict access to any content if we reasonably believe that it:
- breaches these Terms;
- is unlawful or harmful;
- creates legal or reputational risk;
- infringes another person’s rights; or
- threatens the safety, security, or integrity of the Service or its users.
We are not obliged to host, preserve, or continue making available any particular content.
15. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis.
We make no guarantee or warranty that:
- the Service will be uninterrupted, secure, or error-free;
- cards will always be delivered, displayed, or stored successfully;
- the Service will meet every requirement or expectation; or
- defects will always be corrected immediately.
Nothing in these Terms excludes any rights you may have under consumer law that cannot legally be excluded.
16. Limitation of Liability
To the fullest extent permitted by law, Cre8tive Hands and its owners, operators, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive loss or damage, including loss of data, loss of goodwill, loss of opportunity, or failed delivery, arising out of or in connection with:
- your use of, or inability to use, the Service;
- unauthorised access to or use of your content or data;
- errors, interruptions, delays, bugs, or service outages;
- third-party systems or providers; or
- content created, sent, or received through the Service.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death, or personal injury caused by negligence, or any liability that cannot lawfully be excluded.
17. Changes to These Terms
We may update these Terms from time to time.
When we make material changes, we may update the “Last updated” date and, where appropriate, provide notice through the website, by email, or through the Service.
Your continued use of the Service after updated Terms take effect means you accept the revised Terms.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales, except where mandatory local law applies otherwise.
You and Cre8tive Hands agree that the courts of England and Wales will have jurisdiction over disputes arising from or related to these Terms, unless applicable consumer law gives you the right to bring a claim in another court that cannot be excluded.
19. Disputes and Resolution
If you have a concern or dispute relating to the Service, you agree to contact us first and give us a reasonable opportunity to resolve the issue informally before starting formal legal proceedings, unless the law requires otherwise.
We will aim to review and respond to genuine complaints within a reasonable time.
